Terms & Conditions Of Agreement

1. PAYMENTS - An initial booking fee is required to hold shooting dates and pre-production planning. All deposits are non-refundable. It is further agreed that the remaining balance is due to be paid in full 7 days prior to the event and this final payment is non-refundable. Therefore, only two payments should be made which are the deposit and the balance. Any deposit made for a booking that is postponed due to unforeseen circumstances (e.g. acts of God, sudden illness or air travel setbacks) will be transferable to a new date and will be valid for up to 12 months, depending on the service. Our acceptable methods of payment include: Cash, Visa or Master Card, Local Checks and EFT's. Client will pay a US$30 fee for any and all returned checks which Client may write to the Provider as payment for services. We do not accept cash in excess of the amount USD $1000.00 within a 24 hour period.

2. CREATIVE CONTROL - Watkins Multimedia is granted full production and editorial control by the CLIENT regarding all aspects of the production and post-production services for this event. All suggestions and comments from the CLIENT with regards to the style and content of the final multi-media must be submitted before the editing process and will be taken into consideration. Once the photographs and/or films have been edited, they will be turned over to the CLIENT. Watkins Multimedia will not distribute RAW or unedited photographs and/or films under any circumstance. Watkins Multimedia reserves the right to edit and release only the material that is deemed adequate according to its creative quality and standard.

3. DELIVERY OF FINISHED PRODUCT - All digital media will be delivered via an online secure link. CLIENTS who reside in Antigua & Barbuda will be required to pick-up their printed products in person. CLIENTS outside of Antigua & Barbuda will have all printed products mailed directly to your address. Please note that post-production editing can take up to 8 weeks to complete based on the hours of coverage. Upon taking possession of the finished product, the CLIENT must inform Watkins Multimedia of any technical problems, misprints or spelling errors, etc. with the video/photographs within 48 hours. After 48 hours, if a notification has not been received, the CLIENT will be deemed to be satisfied with the product.

4. RESTRICTIONS - Watkins Multimedia will not be held liable for any production problems beyond our control, e.g. bad weather, accidents, poor acoustics/lighting, interference from guests, time limitations, inappropriate/offensive attire etc.

5. WITHDRAWAL - Watkins Multimedia reserves the right to withdraw its commitment to any confirmed booking due to circumstances which may lead to the inefficiency of services offered. All deposits will be fully refunded.

6. FAILURE TO PERFORM - If Watkins Multimedia cannot uphold this Agreement due to fire or other casualty, strike, act of God, illness or other cause beyond its control, then Watkins Multimedia shall return the deposit to the CLIENT but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that materials are damaged in processing, lost through camera malfunction or otherwise lost or damaged without fault on our part. in the event we fail to perform for any other reason, we shall not be liable for any amount in excess of the retail value of the CLIENT’s order.

7. OVERTIME - All of our services are sold with a time limit, therefore it is understood that shooting commences at the requested start time and ends at the scheduled hours sold or agreed upon. A fee is charged for time added on by the CLIENT on the day of the event. This must be paid before finished product is released.

8. PARKING – Watkins Multimedia representative should be provided with reserved parking allocation at the CLIENT’s event for efficient transport of equipment.

9. MEALS - The CLIENT agrees to provide a courtesy meal for the Watkins Multimedia team once the event exceeds four (4) hours of coverage time. The Client will allow for a 10-15 minute break, during their coverage time, for the team to replenish themselves within a reasonable timeframe to avoid missing the capturing of any important moments during the event.

10. EXPENSES INCURRED - When applicable, the CLIENT is responsible for all travel, accommodation, meal and transport costs, vendor fees and all other required fees, unless provided by the CLIENT.

11. COPYRIGHT - The copyright in all photographs, films and other works in respect of which copyright may subsist supplied to the Client will vest and remain vested in Watkins Multimedia as the creative artist. Therefore, the CLIENT shall not sell or alter the photographs, films and other works without the prior written consent of Watkins Multimedia who has the sole discretion in determining whether or not such consent will be given. The CLIENT shall ensure that each photograph, film or other work published, or used in any medium (eg: social media platforms) by anyone other than the CLIENT will carry a caption bearing the name of Watkins Multimedia and a copyright notice.
