1. Payments & Booking Fee
A non-refundable booking fee is required to secure the shoot date and initiate pre-production planning for both event and commercial shoots. The fee compensates for the time reserved exclusively for the client, preventing us from booking other clients for the same date. For event shoots, the remaining balance is due 7 days prior to the event. For commercial shoots, the balance is due within 24 hours after filming is completed. Only two payments should be made: the deposit and the balance. If the booking is postponed by the client due to unforeseen circumstances (e.g., government restrictions, pandemics, travel bans, or other uncontrollable events), the deposit can be applied to a new date within 12 months, without penalty. The deposit remains non-refundable but will be applied to the rescheduled event. Payments are accepted via Cash, Visa/MasterCard, American Express, local checks, and EFTs from local banks. A USD $30 fee will apply for any returned checks.
2. Late Payment Policy
Full payment for any outstanding balance is due within thirty (30) calendar days after the shoot date (for commercial shoots), unless otherwise specified. If payment is not received within this time frame, a late fee of 25% of the total invoice amount will be added. If the balance remains unpaid 15 days after the due date, Watkins Multimedia reserves the right to pause delivery of final media and suspend further work until the account is settled.
3. Creative Control and Usage Rights
Watkins Multimedia retains full creative control over production and post-production processes. Clients are encouraged to provide feedback on style and content before the editing phase begins. Once edited, the final product will be delivered, and no raw or unedited materials will be provided. Watkins Multimedia reserves the right to release only content deemed to meet its creative standards.
Watkins Multimedia also retains the right to use any photographs, videos, and/or other media created for portfolio display, website content, social media marketing, competitions, awards, exhibitions, and promotional materials. The client grants Watkins Multimedia a non-exclusive, perpetual license to reproduce and display the final delivered media for these purposes, without additional compensation.
If the client wishes to restrict the use of specific images or footage for marketing purposes, a written request must be submitted prior to the shoot date and may be subject to a separate exclusivity agreement and additional fee.
4.Delivery and Editing Policy
All digital media will be delivered via a secure online link. Clients in Antigua & Barbuda must collect printed products in person, while international clients will receive their prints by mail. Post-production editing may take up to 8 weeks, depending on coverage hours. Clients must report any technical issues, misprints, or errors within 48 hours of receiving the final product. If no issues are reported, the product will be deemed satisfactory.
For clients requiring expedited delivery, Watkins Multimedia offers a Rush Editing Service, subject to availability and an additional fee. The fee for Rush Editing will vary based on the requested turnaround time. Rush Editing requests must be made in writing at the time of booking or at least 7 days prior to the event/shoot date. Acceptance of Rush Editing requests is at the sole discretion of Watkins Multimedia, based on current production workload and scheduling.
5. Liability Disclaimer
Watkins Multimedia will not be held liable for any production issues beyond our control during the shoot, including but not limited to bad weather, accidents, technical difficulties, poor acoustics, lighting challenges, guest interference, time constraints, or other external factors. As such, no refunds will be provided in these circumstances.
6. Withdrawal Policy
Watkins Multimedia reserves the right to withdraw from this Agreement without penalty in the event that a key team member becomes unavailable due to illness, injury, personal emergencies, or other unforeseen circumstances. Additionally, if at any point during the preparation stages we determine that we are not a good fit for the client's needs or objectives, or if we find that the client’s expectations or behavior may conflict with the values or scope of our services, we reserve the right to withdraw from the Agreement. In such cases, Watkins Multimedia will provide a full refund of any paid deposits and will make reasonable efforts to assist the client by recommending or sourcing a suitable replacement for the event. While we will strive to resolve the situation to the best of our ability, Watkins Multimedia will not be held liable for any additional costs, damages, or inconveniences resulting from the withdrawal.
7. Limitation of Liability and Refund Policy
In the event that Watkins Multimedia is unable to fulfil this Agreement due to circumstances beyond our control before the shoot date, including but not limited to fire, strike, act of God, illness (supported by verifiable medical documentation), or any other unforeseen event, Watkins Multimedia will refund the deposit to the client but will have no further liability regarding the Agreement. This limitation on liability also applies if materials are damaged, lost, or corrupted during post-production (e.g., due to equipment failure, hard drive malfunction, or stolen files), provided that such incidents occur without fault on the part of Watkins Multimedia.
If the services cannot be fully completed for any reason, the liability of Watkins Multimedia will be limited to the amount paid by the client for the services. Watkins Multimedia will make reasonable efforts to resolve the situation, which may include offering a re-shoot or other corrective action where feasible. However, no claims beyond the retail value of the client’s order will be accepted.
Refunds for cancellation or postponement due to illness or other personal reasons will only be considered if verifiable proof is provided (e.g., medical documentation or other reasonable evidence). Claims of cancellation or refund must be supported by documentation deemed satisfactory by Watkins Multimedia. Refunds will not be granted for claims of change of mind or preference.
8. Parking and Meals
The client is responsible for providing reserved parking for the Watkins Multimedia team at the event location to ensure efficient transportation of equipment. Additionally, if the event exceeds four (4) hours of coverage, the client agrees to provide a courtesy meal for the Watkins Multimedia team. A 10-15 minute break will be allowed for the team during the event to replenish themselves, ensuring that important moments are not missed.
9. Overtime
Our services are sold based on a specific time frame. If additional time is required on the day of the event, the client agrees to pay for the extra hours before receiving the finished product.
10. Additional Expenses
The client is responsible for any additional expenses that may arise during the course of the event, including but not limited to travel, accommodation, meals, transport, vendor fees, and any other costs required to access the location (such as entrance fees for parks, boat or airplane trips, etc.). These costs will be discussed and agreed upon in advance if they are necessary, and will be in addition to the service fee for our work.
11. Copyright
Watkins Multimedia retains the copyright to all photographs, films, and other creative works. Clients may not sell or alter these works without prior written consent. Any use of the material by third parties must include proper attribution, including the name of Watkins Multimedia and a copyright notice.
